The Role

The Legal advisor will be required to provide advice and support on all legal & compliance matters pertaining to the business, TCF, policy provisions as well as general advice relating to products, operational practices and scenarios related thereto within the Long-Term Insurance industry. The position will also assist with the interpretation and application of all applicable legislation within the insurance industry.

Tasks and responsibilities will include, but not be limited to:
  • Interpret contracts, legislation, and regulations.
  • Draft and amend contracts, policy documents and other legal documents (Intermediary Agreements, Binder Agreements, Administration Agreements, Service Level Agreements, Reinsurance Agreements, etc.)
  • Ensure all amendments are in line with the most recent client agreements.
  • Analyse legislation, industry codes etc. and provide guidance to the business regarding the impact on the business and assist with the implementation thereof.
  • Assist with complaints if needed.
  • Advise on general legal matters and stay up to date with legal/regulatory changes that have an impact on the business.
  • Provide Legal training and development in terms of gaps identified in the business.
  • Draft legal newsletters to educate internal staff as well as external stakeholders that do not have legal background on regulatory dispensation.
  • Collaborate with the management team and other stakeholders to identify legal risks and provide strategic guidance on mitigating these risks.
  • Assist with compliance issues that need to be attended to in the onboarding environment and assist with providing compliance advice regarding onboarding procedures.
  • Sign off on all client facing documents (advertisements, marketing campaigns, application forms, websites etc.) to ensure compliance with legislation.
  • Compile regulatory compliance processes to assist the group in complying with regulatory obligations.
  • Track and assist with remedial actions following any compliance findings or breaches.
  • Ensure that the company is equipped with all the necessary resources and tools to fulfil all legal and compliance tasks.
  • Assist with basic administration (i.e. accurate filing of any onboarding documentation)
Requirements:
  • LLB post articles
  • Minimum of 2-3 years post articles experience as a corporate legal advisor in the Financial Services Industry
  • General knowledge of commercial and corporate law, contract management and regulatory compliance and reporting.
  • Up to date knowledge and experience of corporate governance including policy development and implementing systems and frameworks.
  • Financial Advisory and Intermediary Services Act, Long Term Insurance Act, Long-term Insurance Act Regulations, PPR, Financial Section Regulation Act and Protection of Personal Information Act, Financial Intelligence Centre Act)
