Senior Compliance Officer, Health Care Compliance Program Lead

The Compliance Officer acts as a member of the Legal & Compliance Department (L&C). The Compliance Officer materially contributes to building, implementing, and managing the health care compliance and (if applicable) the distribution management program of our client in EMEA. The Compliance Officer acts as the first point of contact for business units and functions for healthcare or distribution management compliance matters or other compliance matters or programs. The Compliance Officer leads one or more Centres of Excellence.

Job Scope:

Applies extensive knowledge and expertise in health care compliance, anti bribery and distribution management and leads a consistent implementation of the compliance program in its cluster to the different Business Units through day-to-day advice, training, monitoring, audits and reporting. Handles and coordinates day-to-day legal matters in its cluster under the supervision of a legal counsel.

In his/her role, the Senior Compliance Officer will report to a Compliance Manager or legal counsel and collaborate with and be guided by expert legal counsel. Guides and coaches the compliance coordinators (administrators) of the different businesses in its cluster and if applicable, other compliance officers in its area of expertise.

Leads one or more Centres of Excellence or leads or contributes (depending on the project) to EMEA wide compliance projects such as improving compliance processes and procedures, drafting policies or automation.

Health Care, anti-bribery, and Distribution Management Compliance Program
  • Act as the compliance officer in your cluster and for the distribution management program and give day-to-day guidance and support to all BUs/functions.
  • Advise on Healthcare Company (HCC) and distribution management matters as first point of contact for the country/cluster sales and marketing teams, and any group interacting with an Healthcare Provider (HCP)/Healthcare Organisation (HCO) or distributor from the country/ cluster.
  • Train, coach and guide the country/cluster BU Compliance Coordinator in their tasks related to Health Care Compliance processes and distribution management if applicable and work with BU and functions so that compliance is embedded in all relevant day-to-day operations and processes.
  • Contribute to the development, management, and implementation of a consistent compliance program and to the drafting of policies, procedures, and standards in your cluster/program and throughout EMEA.
  • Identify needs for training and provide training to associates upon hire and on a regular basis after that, with an additional focus on local regulations.
  • Approve requests and draft appropriate documentation and contracts for interactions with local HCP/HCO (HCP Consultancy, local Events, grants & donations, etc.) and for terminating, setting up, extending, or amending distributors (due diligence and contracts).
  • Suggest and perform monitoring activities at local level; assess risks and take appropriate steps to improve the effectiveness of the program.
  • Perform healthcare compliance activities including transparency reporting and compliance contract review.
  • Conduct audits supporting the Internal Audit team.
  • Conduct internal investigations when appointed as an investigator.
  • Provide timely and adequate input for the reporting and other reporting requirements.
  • Act as a lead or co-lead of a Center of Excellence such as distribution management, monitoring, transparency reporting or others as required and design, implement and manage a consistent program for all businesses in EMEA, take the lead of the program, coordinate with all other stakeholders in the Legal and Compliance team and the BUs/functions, draft up to date policies and procedures, providing training and continuously implementing improvements.
  • Act as the owner of the compliance tool or system and ensure technical support is obtained from the vendor, manage KPIs and administer the system, review, and implement improvements.
Legal Support And Support To Other EMEA Compliance Programs
  • Handle day-to-day legal and compliance matters in a variety of legal and compliance areas by supporting legal counsel or acting as a first Point Of Contact towards the business and functions. These matters may include due diligence of customers or suppliers, litigation, training, IP management, corporate housekeeping, ESG (Environmental, social and governance) or others as required.
  • Coordinate contract work, draft and review standard contracts and perform contract management.
  • Contribute to EMEA compliance programs such as international trade, privacy, or others as applicable.
Member of the Legal and Compliance team
  • Actively participate in the team meetings; bring legal and compliance topics to the meetings and ensure alignment and consistent approach on topics in your area of expertise.
  • Actively participate in the compliance meetings
  • Work effectively in the matrix organisation with your colleagues in the legal department and discuss and pro-actively resolve any overlaps or ambiguities and ensure (leading by example) collaboration, open communication and sharing of information with other members in the Legal and Compliance Department. Support close cooperation and communication in the Legal & Compliance Team.
  • Contribute to legal and compliance projects/programs, which may involve drafting and implementing standards, policies, training, and automation and affect multiple business or functions throughout EMEA.
  • Work effectively with and coordinate matters handled by outside counsel, under supervision of a more senior lawyer.
  • Effectively network outside the company with peers in the law community and participate in the activities of industry associations and compliance professional organisations.
  • Report on a regular basis and in a structured manner on the areas you are responsible for.
  • Be discrete and maintain confidentiality.
Compliance expert
  • Act as an internal expert in compliance and in the areas of expertise assigned to you and be the go-to person in your area of expertise.
  • Keep knowledge up to date and provide advice and appropriate training to other members of the legal department.
  • Participate in local trade industry compliance forum if applicable or possible.
  • Consult with Expert Legal Counsel with respect to complex compliance issues, local laws, contract templates and other matters.
Requirements Profile description:
  • Masters degree and a degree in Compliance or on the job experience. Legal knowledge would be an added advantage.

  • Good verbal and written communication skills
  • Good level of IT with Microsoft Office skills
  • Fluent in English (written and spoken). Other languages are a plus.
