Independent Disciplinary Chair Person (Contract)

Our client is seeking an Independent Disciplinary Chairperson who possesses the required expertise in labour law, dispute resolution procedures, and the capacity for impartial evidence assessment and judgment.

Key Responsibilities:

Conduct Disciplinary Hearings:
  • Chair disciplinary hearings in compliance with the codes of good practice, ensuring a fair and unbiased process.
Evidence Review:
  • Thoroughly review all evidence presented during the hearing, ensuring adequate time for consideration before making a recommendation to the CEO.
Finding:
  • Deliver a verdict of guilty or not guilty based on the evidence, followed by a comprehensive report detailing the findings for PASA.
Sanction Recommendations:
  • Suggest appropriate sanctions, if applicable, in accordance with the disciplinary code of PASA, providing justifiable reasons for the decision.
Deliverables:
  • The deliverables would be aligned with the scope of work.
Requirements
  • Hold an LLB degree.
  • Have extensive experience in dispute resolution and disciplinary processes.
  • Demonstrate the ability to remain impartial and fair.
  • Exhibit proficiency in assessing evidence and differentiating between facts, opinions, and hearsay.
  • Justify their findings and recommendations clearly and logically.
  • When a Chairperson is appointed, it should be a senior counsel specialising in labour law.
